Access to Madeleine's investigation files – Details and rules

Two layers from Mr. Pinto de Abreu office started to analyse the files, in the Court of Portimão, this morning. The McCann lawyers requested the Public Prosecutor Office (PPO) to reserve the access to the files (meaning the papers) only for lawyers and arguidos, during a certain period of time. I could not confirm exactly that period of time, some sources said it will be around one month. It makes sense, because you can't have 8 or 10 lawyers, more 30 or 40 journalists poring over the same paper files, at the same time.

Anyway, journalists can request copies of all the files, before that period of time ends. They just need to go to Portimão and file a written request, with a DVD enclosed, to the PPO. They will have a DVD copy in a few days. Requests from journalists will be processed from Monday, August 4, and it's expected that it takes between 2 to 3 days to get the copy. After the above referred period of time, journalists will also have access to the paper files.

No access will be given to what seems to be a small part of the files. Several lawyers I talked with, told me it's normal that personal data from people that has been investigated and ruled out of any relation with the case, is kept confidential.

LUSA/Visão (excerto):

ressalvando, em comunicado, que pode reabrir o processo caso surjam "novos elementos de prova".

bearing in communication, which can reopen the process in the event "new evidence".

Supposedly didn't the McCanns want to have access to all the names of people that the police investigated, even the ones they ruled out. The McCanns did declare that Metedo 3 is more efficient than any police force in the world.
One thing I do know, Metedo 3 isn't very good at making predictions.
To my knowledge Jo, the 81 files that were recently handed over to the McCanns were with regard to people that their detectives had already investigated and had even suggested to the police that they be investigated. The whole thing was a public relations stunt with the objective of getting justice Hogg to proclaim their innocence, which she did.

guerra,

I agree with your post. British judges are not given to 'summing up' without careful consideration of both sides of a case. The total lack of impartiality by justice Hodge raises serious questions, especially the depth and extent of the Government's intervention and influence with her bias. Her comments confirm she has not examined the content of PJ's files, or considered the facts of the case. Her comment confirms unmitigated bias and prejudice, tantamount a lawyer would say to 'influencing' public opinion and the course of justice in Madeleine's death and disappearance.

According to Goncalo's account based on substantiated evidence, no evidence exists to support abduction. Conversely, DNA match of 15 indices out of 17 (88% match) is confirmed by forensic scientists as percentage requirement for proving parentage in Court. Independent forensic scientists also confirm 88% match means the DNA belongs to no other.

Had the 88% DNA match belonged to an abductor, McCanns would have sued PJ for not arresting and charging !! As it's illegal for FSS to withhold results and retain specimens belonging to the police in a serious criminal investigation, paid for by taxpayers, the only logical explanation is that someone 'on high', i.e. Government stopped the results and specimens being given to PJ.

The case is a 'wake up' call to abhorrent behaviour suffered by the police throughout.

"A spokesman for the office of the Attorney General of the Republic confirmed that the Judge, Pedro Frias, responsible for the Madeleine case, received and accepted a request to keep confidential certain very specific information, under the secrecy of justice. He stressed "details are not considered as evidence". The request was, therefore, not made by PJ based on their need to safeguard material evidence.

Files contain identities not in the public domain. It was widely reported and debated in forums that a 'political figure' associated with the McCanns hastily departed Luz on 3 May. A MW employee was reported as stating the person's ID was 'mind blowing' in it's importance.

The request for 'non evidence' material, i.e. names to be withheld is logical if a political VIP is shown, in the files, to be associated with the McCanns.

This also explains the unprecedented level of political interference and corruption in a case concerning the death and disappearance of an innocent child.

Blair, Brown, Miliband & Mitchell have been actively involved in protecting the McCanns from day one. The need to keep ID's on PJ's files 'secret' upholds reports and the theory that the ID of British VIP/politician is being protected, along with the McCanns. The Labour Government, fronted by media manipulator Mitchell, has aided and abetted Gerry's 15 month "fight" against the police and cadaver proof, including obtaining £1.3 m under false pretences ... why ?

The answer lies in PJ's files - all parties present are named.
The 'case' has been 'political' from day one. Goncalo's efficiency was not to the Government's & McCanns' liking.
